Daymaker LLC (“we,” “our,” or “us”) respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains how we collect, use, share, and safeguard your information when you visit our website, register for classes or memberships, make a purchase, or otherwise engage with our fitness studio and related services.
This policy is designed to comply with the New Hampshire Data Privacy Act (“NHDPA”), RSA 507-H, which took effect on January 1, 2025. If you are a New Hampshire resident, Section 7 describes your specific rights under this law.

1. Information We Collect
A. Information You Provide Directly
Personal and contact information: name, email address, phone number, and billing address.
Account information: login credentials if you create an account with us.
Health and wellness information: voluntary disclosures such as fitness goals, injuries, or medical considerations provided for safe and effective class participation.
Payment information: collected and processed securely by our third-party payment processor. We do not store your full credit card details.
Emergency contact information.

B. Information Collected Automatically
Technical data: IP address, browser type, device information, and usage patterns when you interact with our website.

4. Targeted Advertising
We use your personal data for targeted advertising purposes, which means we may share certain data with advertising partners to show you ads relevant to your interests on third-party platforms and websites.
You have the right to opt out of targeted advertising at any time. To do so:

Additional protections under the NHDPA:
We will not discriminate against you for exercising any of the above rights — we will not deny you services, charge different rates, or provide a lesser quality of service.
You may receive information in response to a request free of charge once during any 12-month period.
You may designate an authorized agent to exercise your opt-out rights on your behalf.
A parent or legal guardian may exercise rights on behalf of a minor child.

8. How to Exercise Your Rights

We will respond to your request without undue delay, and no later than 45 days of receipt. If we need additional time due to the complexity of your request, we may extend this period by up to an additional 45 days. If we extend the response period, we will notify you within the initial 45-day window and explain the reason for the extension.
We may need to verify your identity before processing your request. We will not require you to create a new account solely for the purpose of exercising your rights.
If we are unable to take action on your request, we will inform you of the reason and provide instructions on how to appeal our decision.

9. Appeals Process
If we decline to take action on your privacy rights request, you have the right to appeal our decision. To appeal, please contact us at privacy@daymakerfitnessandwellness.com with the subject line “Privacy Rights Appeal” and include the details of your original request and the reason you believe it should be honored.
We will respond to your appeal in writing within 60 days of receipt, including an explanation of the action taken or not taken and the reasons for our decision.
If your appeal is denied, you may contact the New Hampshire Attorney General’s Office to submit a complaint. The Attorney General has exclusive authority to enforce the NHDPA. Complaints may be submitted at: https://www.doj.nh.gov or by emailing CPB-DOJ@doj.nh.gov.
